Crazyhorse Posted October 10, 2010 Report Posted October 10, 2010 there were 2 arms hanging outta that coffin trying to figure out how to get the last nails in. Quote
uhcougs Posted October 10, 2010 Report Posted October 10, 2010 Did they not have sunoco title sponsorship this year? I know that in talking to Huth several years ago in the pits in Houston, he badly wanted to a national tour out there again under the official ASA banner and that the LM series was slowing down those efforts. Sad to hear that for Ron and his wife. They put A LOT into that tour over the last few years to keep it what it was. Quote
NickHolt Posted October 11, 2010 Report Posted October 11, 2010 And here is the release about the court order: ++++++++++++++++++++++++++++++++++++++++++ COURT ORDER BARS SERIES OWNER AND AFFILIATES FROM ANY FURTHER USE OF ASA AND ASA LATE MODEL SERIES NAME American Speed Association PR DAYTONA BEACH, FL (Monday, October 11, 2010) - The UNITED STATES DISTRICT COURT for the Northern District of Illinois, in an Order signed on October 7, 2010 by US District Court Judge Matthew Kennelly, has permanently barred Louis R. (Ron) Varney, Jr, ASA Late Model Series, LLC and all those acting in concert or participation with them, including specifically ASALMS, LLC from any further use of the ASA or ASA LATE MODEL SERIES brand on or in connection with automobile race events anywhere in the United States. In addition to the permanent injunction, the Court ordered that all rights in the ASA Late Model Series name will revert to Racing Speed Associates, LLC owner of the American Speed Association and ASA family of trademarks. The Order takes effect immediately with enforcement procedures in process now. The Court's Order ends the long running dispute between Mr. Varney and RSA founder Dennis Huth over the exclusive use of the ASA name. "We settled our differences nearly 2 years ago with an Agreement that tried to carve out areas where we could both operate. Varney just crossed the line too many times and caused unacceptable confusion in the marketplace," Dennis Huth, ASA President said. "We had no choice but to enforce our rights." Throughout this court process, Varney was given many opportunities to provide his side of the case to Judge Kennelly, but failed to appear at the hearings or provide a written response. "Racing Speed Associates, LLC d/b/a American Speed Association/ASA Racing will take a tough position on any illegal uses of the ASA name going forward," Huth said. "The ASA brand has been well regarded for many years and we are doing what is necessary to protect our fans and ASA Member Tracks and Series. ASA is very well known and successful in short track racing and we need to clear up the confusion that has been going on in the past five years. Now, when you see the ASA name, you will know it represents one source providing the best in short track automobile racing." The American Speed Association was created by the Robbins Family in 1968 and quickly became one of the most successful short track series in the United States. Huth's Racing Speed Associates, LLC bought the American Speed Association in 2005. Today they continue to focus on the ASA Member Track program, that was created in 2001, along with sanctioning multiple racing series in the United States. Today, the American Speed Association sanctions over 30 ASA Member Tracks, 10 Sanctioned Series, and over 800 racing events each year ranging from asphalt, dirt and road course events. This past January ASA sanctioned the first ever American style stock car race at the Phakisa Freeway Circuit in Welkom, Free State, South Africa. The event was live on Sirius-XM Satellite radio and televised in 72 countries reaching 110 million households. Are you saying that the rightful owner of trademark should just allow anyone to use it however they please? C'mon man, you know that's not how it works in this country. Quote
